Naomi,
A) Apparently, the EDD UI account doesn't just go into collections. Based
on the statement I just received, they tack on penalties for a while first.
Our reimbursement balance owed through 30 Sept (I stopped drawing 9/1) is
$8,657.92, including $400 penalty and interest and crediting our payments
totaling $189.77.
Do you know of any other options than these:
1. Pay them what they say we owe, which we can't.
2. Allow penalties to stack until they put us in collections, which
would truly finish ABC.
3. Declare us closed, assuming that this will put us in collections more
quickly and allow for a payment plan.
It seems to me that my next move should be to call them again on Monday and
become better educated about our options. Is that how it seems to you? When
last I called them, they said what you said: that we'd be able to set up a
payment plan once in collections. They failed to mention the extensive
penalties.
B) I have also attached the EDD's "Benefit Audit". Are you able to complete
this for us?
Brandon
Checking in again about this. Is there a better way to contact you about
time-sensitive matters?
Brandon
Thanks! I wonder why the Nov 18 email didn't find you... Stuff like that
bugs me until I can figure out how to fix it.
Surely the EDD doesn't benefit from crushing an org that owes them. I left
another message asking for a call, and will keep trying until that
conversation happens. I went ahead and filled out the Benefit Audit, in
case you didn't reply, but haven't sent it yet because it is a little weird
to be the interested ex-employee, now a contractor, and the reporting
representative. What do you think? Should I rip this up and you do it? It
just involves checking the box to indicate that I did not get paid by ABC
while receiving UI money.
Brandon
Thanks!

bankruptcy, which would allow the organization to “restructure” debts while
still operating. I can’t speak to all that is involved to make that happen,
but if it’s not something you’ve looked into already, it might be worth
some research. My guess is you’d need a CA attorney to make that happen.

gone into collections (that hasn’t happened yet). Once you receive a notice
stating the account is in collections, you can call the department to set
up the plan. Alternatively, you can call the department every two or three
weeks to check the status of the account. Since I’m not named on the
account, I’m unable to set up the plan – this is something that will have
to be authorized by you (or another officer). If the account isn’t put into
a payment plan once it goes into collections, and it becomes severely
delinquent, the officer(s) on the account become liable for the balance
due. Again, as I’m not named on the account, he was unable to tell me if
that would be you, or other officer(s). So, the goal will definitely be to
keep the account current and / or honor the payment plan once it goes to
collections. I can make payments online at any point.
